TERMS AND CONDITIONS

  •  Payment for all orders is made at the point of sale, and not at the point of dispatch. 

  •  By making a purchase, you specifically authorise Ivy & Willow Botanicals to submit information to PayPal or Wix payments for authorisation. 

  •  If your PayPal or Wix payments declines authorisation for any reason,

  • Ivy & Willow Botanicals cannot be held liable for any delay in dispatch or non-delivery.

  •  All payments are processed and authorised by PayPal orWix payments 

  • (for credit or debit card payments).

  •  All sensitive credit or debit card data entered at checkout is processed and saved on Wix payment  secure servers.

PRIVACY AND INTELLECTUAL PROPERTY

  •  We respect your privacy rights and recognise the importance of protecting the information we collect about you. The information you provide will only allow us to process orders efficiently; and to alert you to new products, special offers and news relating to Ivy & Willow Botanicals

  •  We will never share your information with parties outside our organisation (except if required by law, court order or law enforcement authority) 

  • By using this site, you acknowledge that all intellectual property rights in the goods supplied, including copyright, design rights and trademarks belong to Ivy & Willow Botanicals or our suppliers. 

  • All designs, text and images of Ivy & Willow Botanicals products provided on the website are protected by copyright and may be reproduced only on websites which provide

  • We receive, collect and store any information you enter on our website or provide us in any other way. In addition, we collect the Internet protocol (IP) address used to connect your computer to the Internet; login; e-mail address; password; computer and connection information and purchase history.

  • We may use software tools to measure and collect session information, including page response times, length of visits to certain pages, page interaction information, and methods used to browse away from the page.

  • We also collect personally identifiable information (including name, email, password, communications); payment details (including credit card information), comments, feedback, product reviews, recommendations, and personal profile.

When you conduct a transaction on our website, as part of the process, we collect personal information you give us such as your name, address and email address. Your personal information will be used for the specific reasons stated above only.

  • We collect such Non-personal and Personal Information for the following purposes:

  • To provide and operate the Services;

  • To provide our Users with ongoing customer assistance and technical support;

  • To be able to contact our Visitors and Users with general or personalized service-related notices and promotional messages;

  • To create aggregated statistical data and other aggregated and/or inferred Non-personal Information, which we or our business partners may use to provide and improve our respective services; 

  • To comply with any applicable laws and regulations.

RETURNS

  •  We endeavor to dispatch all orders within 5 working days from when your order is placed and the payment is received.

  • You may cancel your contract with Ivy & Willow and return an item(s) to us for a full refund (minus the original delivery costs), within 30 days of receiving your order.  To cancel your order you must notify us in writing by email to hello@ivyandwillowbotanicals.co.uk  quoting your name and order reference number.

  •  In the event of an order cancellation on your part (a return within 30 days), you are required to cover the cost of returning the item(s) to Orchard Cheshire.

  • We cannot reimburse you for this cost unless the item is faulty or has been damaged in transit.

  • In the unlikely case your order is faulty or has been damaged in transit, please contact us at your earliest opportunity by emailing us at hello@ivyandwillowbotanicals.co.uk

  • We will either replace the damaged item and dispatch it free of charge within 5 working days, or refund the price you paid for the item including postage. 

  • The decision to refund or replace the damaged item, is at the discretion  of ivy & Willow Botanicals

  • We reserve the right to require proof of damage: You can either photograph the damage and email it to us at hello@ivyandwillowbotanicals.co.uk   or return the item to our postal address (which we will supply to you). If the item is found to be faulty or damaged, we will refund the price you paid for it, and reimburse you for the returns postage. If the item is found not to be faulty or damaged, we cannot refund you for the item, or reimburse you for the return postage costs.

  •  Once an item has been dispatched, we’re not able to accept returns or exchanges for items that have been personalised or made to order, unless that item has been damaged in transit or is found to be faulty.

  •  In the event of a cancellation, we will reimburse you without undue delay and within 14 days from the  day we receive the returned items or, if earlier, 14 days from the day we receive a proof of postage of your returned order from you. We will reimburse you using the same payment method you used originally.

  • Ivy & Willow Botanicals reserve the right to cancel the contract between the customer, in an unlikely case, if:

           – we have insufficient stock to deliver the goods you have ordered;

           – we are not able to deliver to your area; or

           – one or more of the products you have ordered has a pricing, description or technical issue.

COUPON CODE DISCLAIMER

  •  Coupon codes issued can only be used until their expiry date. 

  •  The offer can only be used once against a purchase and coupon codes cannot be used in conjunction with any other promotional offer such as discount offers, products reduced in price, sample sale or seasonal sale. 

  • Ivy & Willow Botanicals reserves the right to remove coupon codes without warning due to insufficient stock, technical issues or misuse of a coupon code. 

  •  Coupon codes issued can only be used in conjunction with any specified terms and conditions of use.

  • Ivy & Willow Botanicals reserves the right to change or alter specified terms and conditions of use at any time without prior notice.

  •  Ivy & Willow Botanicals reserves the right to cancel orders if Ivy & Willow Botanicals  finds a coupon code has been misused or used against the coupon code’s terms and conditions of use without prior notice.

  • Our company is hosted on the Wix.com platform. Wix.com provides us with the online platform that allows us to sell our products and services to you.

  • Your data may be stored through Wix.com’s data storage, databases and the general Wix.com applications. They store your data on secure servers behind a firewall. 

  • All direct payment gateways offered by Wix.com and used by our company adhere to the standards set by PCI-DSS as managed by the PCI Security Standards Council, which is a joint effort of brands like Visa, MasterCard, American Express and Discover. PCI-DSS requirements help ensure the secure handling of credit card information by our store and its service providers.

ENVIROMENTAL STATEMENT

  •  We make every effort to use environmentally friendly and recycled packaging for our deliveries, however on occasion, to ensure the product reaches you in perfect condition we have to make exceptions.

 Many of our products are sourced from independent designers and makers, and many of our products use environmentally friendly printing or manufacturing methods and materials.

LEGAL STATEMENT

  • Ivy & Willow Botanicals total liability for any claim howsoever arising shall not exceed the price of the goods supplied by Ivy & Willow Botanicals to the customer. 

  • Ivy & Willow Botanicals shall not be liable for any consequential customer loss whether this arises from a breach of duty in contract or any other way. 

  • Ivy & Willow Botanicals cannot accept any liability for a failure to comply with specific instructions stated in the catalogue or on the product. Your statutory rights are not affected by this statement. 

  •  If any term of the Agreement is held to be illegal, invalid or unenforceable, in whole or in part, such part shall be deemed not to form part of the Agreement but the legality, validity or enforceability of the remainder of the Agreement shall not be affected.

  • We reserve the right to modify this privacy policy at any time, so please review it frequently. Changes and clarifications will take effect immediately upon their posting on the website. If we make material changes to this policy, we will notify you here that it has been updated, so that you are aware of what information we collect, how we use it, and under what circumstances, if any, we use and/or disclose it.
